25-year-old Zelvin Geovani Pavon Gomez faced a Baldwin County judge after a serious accident on County Road 28 in Summerdale around 3 a.m. Gomez, who was driving 68 mph in a 45 mph zone, crashed into a fence, causing his vehicle to roll and ejecting his girlfriend’s 6-year-old daughter, trapping her underneath.

A neighbor woke to a medical helicopter rushing the girl to the hospital. Tire tracks and broken glass in his yard showed the crash’s severity.

Prosecutors revealed that Gomez’s blood alcohol level was .22, nearly three times the legal limit, even three hours after the crash. Gomez remains in Baldwin County jail, charged with first-degree assault and DUI, with bond set at over $150,000. Immigration officials confirmed Gomez is in the U.S. illegally after his asylum request from Honduras was denied.

The girl is in critical condition in the hospital.
